Welcome to Kreatown ("we", "us", or "our"). By accessing or using the Kreatown platform, website, or any related services (collectively, the "Service") located at kreatown.com and kreatown.com.tr, you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including creators, fans, and visitors.
You must be at least 18 years of age to use Kreatown. By creating an account, you represent and warrant that:
If you are registering on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
To access most features of Kreatown, you must create an account. When registering, you agree to:
You may not share your account credentials with others or create accounts on behalf of someone else without authorization. We reserve the right to suspend or terminate accounts that violate these Terms.
Creator accounts. Creators are users who publish content and offer membership tiers to fans. As a creator, you are solely responsible for the content you publish and your relationship with your subscribers.
Membership tiers. Creators may set up free and paid membership tiers. Fans who subscribe to a paid tier authorize recurring charges. Creators must clearly describe what each tier includes.
Fan subscriptions. Fans subscribing to a creator's paid tier authorize recurring monthly charges to their payment method. Subscriptions auto-renew unless cancelled before the renewal date.
Cancellations by fans. Fans may cancel a subscription at any time. Upon cancellation, access continues until the end of the current billing period. No partial refunds are issued for unused time unless required by law.
Platform subscription plans. Creators must also subscribe to a Kreatown platform plan (Starter, Pro, or Studio) to publish content. See Section 5 for pricing and fee details.
Platform fees. Kreatown charges creators a monthly platform subscription fee and a percentage of fan subscription revenue:
Payment processing. All payments are processed by Stripe, Inc. By using paid features, you agree to Stripe's Terms of Service. Kreatown does not store your full card details.
Payouts. Creators receive their earnings via Stripe Connect. Payouts are subject to Stripe's payout schedule and any applicable processing fees. You must complete Stripe's identity verification to receive payouts.
Taxes. You are solely responsible for determining and paying any taxes applicable to your earnings. Kreatown may issue required tax documentation where legally obligated.
Refunds. Platform subscription fees are non-refundable except where required by law. Fan subscription refunds are at the creator's discretion and subject to applicable consumer protection laws.
Failed payments. If a payment fails, we may retry the charge. If payment cannot be collected, we may suspend or downgrade your account.
Your content. You retain full ownership of all content you create and publish on Kreatown. By posting content, you grant Kreatown a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and promoting the Service.
Content responsibility. You are solely responsible for content you publish. You represent and warrant that:
Kreatown IP. The Kreatown name, logo, platform design, and all related intellectual property are owned by Kreatown. You may not use our branding without prior written permission.
DMCA. We respect intellectual property rights. To submit a copyright infringement notice, contact legal@kreatown.com.
You agree not to use Kreatown to:
Violation of these rules may result in immediate account termination and, where appropriate, referral to law enforcement.
Your privacy matters to us. Our collection and use of your personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
By using Kreatown, you consent to the collection and processing of your data as described in the Privacy Policy. If you are located in the European Union or Turkey, additional rights apply to you as described therein.
By you. You may close your account at any time by contacting us at hello@kreatown.com. Upon closure, your content will be removed and your active subscriptions cancelled.
By us. We reserve the right to suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion, with or without notice.
Effect of termination. Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.
As-is service. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
No guarantee of uptime. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation. To the fullest extent permitted by law, Kreatown's total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to Kreatown in the three months preceding the claim, or (b) $100 USD.
Exclusion of damages. In no event shall Kreatown be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kreatown is registered, without regard to its conflict of law provisions.
For users in Turkey, any disputes shall be subject to Turkish law and the jurisdiction of Istanbul courts.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where the changes are material, notify you via email or a prominent notice on the platform.
Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree with updated Terms, you must stop using the Service.
